Beatriz, a young woman/mother from a rural area of El Salvador, in extreme poverty and with lupus who fought for her life against the State to allow her to terminate a pregnancy that put her at risk and in which the product was diagnosed with malformations that would prevent it from living outside the uterus.

2012, March
Beatriz, who suffered from lupus, became a mom at age 21

After a high-risk pregnancy that endangered her life and health and aggravated her lupus, Beatriz became the mother of a premature baby boy.
Despite economic and health problems, Beatriz was determined to provide her son with a good life. 

2013, March
State denies termination, her life in danger

The doctors refuse to terminate the pregnancy. Despite recognizing that it is the only way to save her life, they fear imprisonment.
Beatriz is forced to continue with a pregnancy that day by day was taking her life.

2013, May
The State turns its back, for a second time

The Constitutional Chamber denies Beatriz's request. The highest Salvadoran authority, which was supposed to protect her rights, denies her protection.
With its ruling, the medical personnel's hands are tied even though they know that only the abortion could save her.

2013, May
Beatriz sues the State

81 days later, Beatriz is able to terminate her pregnancy, her health is seriously affected and she needs medical treatment. The medical procedures leave her health changed for the worse.
Beatriz sues the State: she demands reparations and that no other woman should experience what she did.

Beatriz becomes pregnant for a second time, severe fetal malformations detected

With her 9-month-old son, Beatriz arrives at the hospital, experience a health crisis. The doctors identify a new pregnancy. They recommend termination because the fetus has not developed a skull and brain. Continuing the pregnancy would affect her fragile health and endanger her life.

2013, April
Beatriz's story crosses frontiers

Beatriz is throated for confronting El Salvador and expressing her desire to live. The international community stands in solidarity with her and demands the immediate termination of her pregnancy.
Anticipating the worst-case scenario, organizations take the case to the IACHR.

2013, May
The IACHR Court orders the intervention

People take to the streets in protest, demanding immediate termination of the pregnancy.
The IACHR and organizations ask the IACHR Court to intervene. The IACHR Court decides to protect Beatriz and forces the State to terminate the pregnancy.

2017, October
Beatriz passed away on October 8, 2017.

Beatriz dies of hospital-acquired pneumonia after being admitted for a traffic accident. After all that had happened, Beatriz's health was too fragile to resist any longer. Her son was orphaned at the age of 5 and left in the care of his family.

Beatriz's story is not the only one

In 1997, El Salvador's Penal Code was reformed to establish the prohibition of abortion. Since then, women who suffer a health emergency during pregnancy have been persecuted.

 According to the "From Hospital to Prison" investigation, 181 cases were prosecuted between 1998 and 2019, which allows "identifying the legal impact of the current penalizing legislation." As of today, the number of cases prosecuted has increased to 196.

Beatriz's case is emblematic because it exposed the serious consequences of the criminalization of pregnancy termination, a restriction that prevented her from accessing an abortion in a timely manner when her life and health were at risk.
